The Supreme Court held that the Court of Session at Madras has jurisdiction to try the offence of criminal conspiracy under Section 120-B IPC, even if the conspiracy was committed outside its territorial jurisdiction, as long as the offences committed in pursuance of that conspiracy occurred within its jurisdiction. The Court clarified that Section 239 of the Code of Criminal Procedure, 1898 allows for this jurisdictional overlap, and thus the appeal against the Madras High Court's dismissal of the application for quashing the commitment was dismissed.
