Judgment text excerpt

The Supreme Court upheld the constitutional validity of Section 3 of the Import and Export Control Act, 1947, and Paragraph 6(h) of the Imports (Control) Order, 1955, ruling that the canalization of imports through specialized channels is a reasonable restriction in the interest of the general public. The Court found that these provisions do not violate Articles 14, 19(1)(f) and (g), or Article 31 of the Constitution, as the refusal to grant a license does not amount to acquisition of property rights. The petitioners' claims regarding the infringement of their fundamental rights were therefore dismissed.
