The Supreme Court held that under Section 13 of the East Punjab Urban Rent Restriction Act, 1949, a tenant must put the landlord in possession upon termination of tenancy as per Section 108(q) of the Transfer of Property Act, 1882. The Court found that the High Court erred in ruling that the Singer Sewing Machine Company had no interest in the tenancy after August 31, 1954, and that the assignment to respondent 1 was valid without the landlord's consent. The Court reinstated the Controller's order for eviction, confirming the maintainability of proceedings against both respondents.
