The Supreme Court held that the proceedings initiated under Section 234 of the Ajmer Merwara Municipalities Regulation, 1925, were recovery proceedings and not criminal in nature, thus the Magistrate was not an inferior criminal court under Section 439 of the Code of Criminal Procedure. The Court clarified that the nature of the enquiry was limited and ministerial rather than judicial, and the absence of prescribed rules for demand notices did not render the statutory power to make demands unenforceable under Section 222(1). The appeal was dismissed as the Magistrate's order was upheld.
