Judgment text excerpt
The Supreme Court held that the District Council had the authority to remove a tribal chief under the general administrative powers conferred by the Sixth Schedule of the Constitution, despite the absence of specific laws governing such removals. The Court clarified that until a law is enacted regarding the appointment or removal of chiefs, the District Council could exercise its administrative powers. The interim suspension of the chief was deemed valid, but he was entitled to remuneration during this period as no statute permitted withholding it. The case of Management of Hotel Imperial v. Hotel Workers’ Union was applied.
