The Supreme Court held that the closure of the Koraput and Berhampur agencies by the appellant was not bona fide, as established under Section 25F(c) of the Industrial Disputes (Appellate Tribunal) Act, 1950. The Court found that despite the actual closure, the tribunal's conclusion that the agencies should be deemed to continue was unjustified. Consequently, the Court overturned the tribunal's award directing reinstatement and compensation for the retrenched workers, ruling that the closure was valid in law despite the tribunal's findings of mala fides.
