The Supreme Court ruled that unskilled seasonal workmen in the Bihar Sugar Industry are entitled to a retaining allowance of 5% of their basic wage during the off season. The Court emphasized that while the primary responsibility for unemployment relief lies with the State, the industry must also contribute to alleviating the distress of these workers. It was held that raising the wage structure is a more effective solution than merely providing a retaining allowance, and the matter should be addressed by the wage board responsible for fixing workers' wages.
