Judgment text excerpt

The Supreme Court held that in a trial by jury, the judge's charge must lead to a correct appreciation of evidence, as per Sections 162, 297, 323, and 325 of the Code of Criminal Procedure, 1898. If the charge contains misdirections, the jury's verdict cannot be upheld. In this case, while the judge's lengthy charge was due to the complexity of facts, it was ultimately found that there was no misdirection, and the jury's verdict was upheld. However, the dissenting opinion noted significant misdirections that warranted interference with the verdict.
