The Supreme Court upheld the validity of Section 6(2) of the Bombay Tenancy and Agricultural Lands Act, 1948, which allows the Provincial Government to fix a lower maximum rent for tenants. The Court established that while legislative power can be delegated, it must not delegate essential legislative functions without providing adequate guidance. The Court found that the Act's preamble and provisions sufficiently articulated the legislative policy aimed at improving the economic conditions of peasants, thus rejecting the challenge of excessive delegation under Article 226 of the Constitution.
