The Supreme Court held that the maintenance grant under the Saranjam estate was governed by the Saranjam Rules and could be resumed by the Government upon the death of the holder. The Court ruled that the plaintiff, V, was not entitled to the lands as the Government's order dated December 17, 1941, was valid and the suit was barred under Section 4 of the Bombay Revenue Jurisdiction Act, 1876. The custom of lineal primogeniture did not divest the Government's right to resume the grant, and the claim was thus dismissed.
