Judgment text excerpt
The Supreme Court upheld the Himachal Pradesh Abolition of Big Landed Estates and Land Reforms Act, 1953, validating it under the Himachal Pradesh Legislative Assembly (Constitution and Proceedings) Validation Act, 1958. The Court ruled that Parliament had the competence to enact the validating Act under Article 248 and that the provisions of the Abolition Act did not infringe Articles 19 and 31 of the Constitution, falling within the protection of Article 31A. The challenge to the constitutionality of the Ordinance and the validating Act was dismissed.
