The Supreme Court held that under Section 1(2) of the Calcutta Thika Tenancy Amendment Act, 1953, no relief under the now-omitted Section 28 of the original Thika Tenancy Act, 1949, could be granted for cases pending on the date of the amendment. The court established that statutory provisions affecting substantive rights are generally prospective unless expressly stated otherwise. The judgment overruled Deorajan Devi v. Satyadhan Ghosal, [1953] 58 C.W.N. 64, clarifying the principles of statutory interpretation and the need for judicial decorum in conflicting decisions among benches.
