Judgment text excerpt

The Supreme Court addressed the issue of bonus distribution under the Full Bench formula established in Mill Owners Association, Bombay v. The Rashtriya Mill Mazdoor Sangh, (1950) L.L.J. 1247. The Court held that while there may be merit in revising the formula due to changing employer practices regarding rehabilitation expenses, such a revision should be undertaken by a high-powered commission rather than the Court. The existing formula was deemed to have functioned satisfactorily across various industries, and the determination of bonus claims should continue to be based on this formula without revision.
