The Supreme Court held that under Section 12 of the Industrial Disputes (Appellate Tribunal) Act, 1950, a party exonerated from an industrial dispute award cannot appeal as they are not an aggrieved party. The Court clarified that only the Official Liquidator, as per Section 457 of the Companies Act, 1956, is authorized to initiate legal proceedings on behalf of a company in liquidation. The appeal by the managing director and auction-purchaser was dismissed as incompetent due to lack of proper authorization from the High Court.
