Judgment text excerpt

The Supreme Court upheld the constitutionality of the Uttar Pradesh Transport Service (Development) Act, 1955, and the notifications issued under it, rejecting the appellants' claims that the Act was void under Article 254(1) of the Constitution due to the subsequent Motor Vehicles (Amendment) Act, 1956. The Court found that the amendment to Article 31 by the Constitution (Fourth Amendment) Act, 1955, validated the impugned Act, as it removed previous constitutional limitations. The Court held that the scheme of nationalization was valid and did not violate the Constitution.
