The Supreme Court held that Section 43A of the Motor Vehicles Act, 1939, as amended by the Motor Vehicles (Madras Amendment) Act, 1948, does not confer a vested right to applicants for stage carriage permits. The Court ruled that orders issued by the State Government under this section are administrative in nature and do not have the force of law regulating rights of parties. Consequently, the order of the Central Road Traffic Board was upheld, as it acted within its jurisdiction despite the issuance of new restrictions during the appeal process.
