Judgment text excerpt

The Supreme Court held that Clause 9 of the Imports Control Order, 1955, does not grant unbridled authority to cancel an import licence and must comply with the principles of natural justice as outlined in Clause 10. The Court clarified that it is not necessary to prove that the licensee was complicit in the fraud for cancellation to occur, as the legitimacy of the licence is compromised if obtained through misrepresentation. The Court upheld the constitutionality of the provisions, affirming that they do not infringe Articles 19(1)(f) and (g) or Article 31 of the Constitution of India.
