The Supreme Court held that field workers employed by a sugar factory to guide, supervise, and control the growth and supply of sugarcane are considered employees of a 'Commercial Establishment' under Section 2(3) of the United Provinces Shop and Commercial Establishment Act, 1947. The Court found that the provisions of the Factories Act, 1948, do not apply to these workers as they are not employed within the factory premises. The High Court's acquittal of the respondents was overturned, and the original convictions under Section 26 of the Act were reinstated.
