Judgment text excerpt
The Supreme Court held that 'Lal-liti' lands are part of a taluqdari estate under Section 2(3) of the Bombay Taluqdari Abolition Act, 1949, despite no revenue being paid historically. The Court clarified that Section 5(1)(a) of the Act applies to all taluqdari lands, while Section 5(1)(b) specifically addresses the liability of taluqdars and their cadets. Consequently, the appellants, as holders of 'Lal-liti' lands, are liable for land revenue under the Bombay Land Revenue Code, 1879, as the Taluqdari tenure was abolished by the 1949 Act.
