Judgment text excerpt

The Supreme Court upheld the constitutional validity of Clause 11B of the Iron and Steel (Control of Production and Distribution) Order, 1941, and the notification issued under it, stating that they do not violate Articles 19(1)(f) and (g) of the Constitution. The Court clarified that the delegation of powers under Section 3 of the Essential Supplies (Temporary Powers) Act, 1946, does not suffer from excessive delegation, as the order provides a framework for the Controller to fix maximum prices. The High Court's ruling was reversed, affirming the legality of the price control measures.
