Judgment text excerpt

The Supreme Court held that the Bihar Hindu Religious Trusts Act, 1950, does not apply to private trusts, affirming that the trust deed executed by the respondent was a private endowment for the worship of a family idol. The Court ruled that the Act's provisions, which were challenged as ultra vires the Constitution, do not interfere with the rights of citizens under Part III of the Constitution. The Court also clarified that the Act does not extend to properties situated outside the State of Bihar, thus upholding the respondent's application for quashing the proceedings initiated by the Bihar State Board of Religious Trusts under Sections 59 and 70 of the Act.
