The Supreme Court held that the High Court has wide discretionary powers under Section 439 of the Code of Criminal Procedure to examine the legality of any finding, sentence, or order passed by an inferior court, even in cases where the petitioner has died during the pendency of the revision. The Court clarified that the principle of Section 431 does not apply to revision cases, and thus the High Court erred in limiting its powers. The Court set aside the High Court's decision that refused to consider the legality of the conviction and sentence after the petitioner's death.
