Judgment text excerpt

The Supreme Court held that the bonus awarded by the Industrial Court to the operatives of Tata Mills Ltd. does not constitute 'wages' under Section 2(vi) of the Payment of Wages Act, 1936. The Court ruled that since the bonus was not remuneration payable upon fulfillment of the terms of the employment contract, the Authority had no jurisdiction to entertain applications under Section 15 of the Act. Consequently, the appeals against the Bombay High Court's dismissal of the writ petition were upheld, affirming the Mills' position.
