Judgment text excerpt

The Supreme Court held that the cancellation of a contract for the supply of milk to a government hospital did not infringe the fundamental rights under Articles 14, 16(1), 19(1)(g), and 31 of the Constitution. The Court clarified that a contract for supply of goods does not equate to a contract of employment, and thus Article 16(1) regarding equal opportunity in employment was not applicable. The petitioner could not claim protection under Article 14 as the selection of one supplier over another does not constitute discrimination under the law.
