The Supreme Court held that under Section 423(1)(a) of the Code of Criminal Procedure, the High Court has the authority to reverse an acquittal and convict the accused for an offence supported by evidence. However, the Court found that there was no provision in the competition rules mandating that entry fees be reserved for prize payments, thus the appellant could not be convicted for misappropriation under Section 403 of the Indian Penal Code. The Court ultimately ruled that the appellant was not guilty of the charges brought against him.
