Judgment text excerpt

The Supreme Court ruled that under Section 6-A of the Uttar Pradesh Industrial Disputes Act, 1947, the awards must be submitted within a specified time, which was interpreted as 40 days based on the original order of reference. The Court held that the first award was invalid as it was submitted beyond the stipulated time and could not be validated by Section 3 of the Uttar Pradesh Industrial Disputes (Amendment) Ordinance, 1953. However, the second award, although submitted beyond the original 40 days, was validated under Section 3(2) of the Ordinance due to the retrospective effect of the amendment.
