The Supreme Court ruled that Rule 12 of the Assam Fishery Rules is not ultra vires and does not conflict with Section 16 of the Assam Land Revenue Regulation, 1 of 1886. The Court established that the State Government has the discretion to frame rules regarding the acquisition of fishery rights, and Rule 12 allows for settlements other than by sale. The previous ruling in Nuruddin Ahmed v. State of Assam was overruled, affirming the validity of the Fishery Rules.
