Judgment text excerpt

The Supreme Court held that a Hindu widow can execute a deed of gift in favor of her daughter as marriage dowry, even if executed after the marriage, fulfilling an ante-nuptial promise. The Court found that under the Benares School of Hindu Law and the Hindu Succession Act, 1956, the deed was valid and binding on reversioners, despite the trial court's ruling that it was not binding beyond the widow's lifetime. The appeal was allowed, affirming the widow's right to make such a gift under Hindu Law, independent of Section 123 of the Transfer of Property Act.
