Judgment text excerpt

The Supreme Court held that under the Motor Vehicles Act, 1939, a renewal of a permit is a continuation of the original permit and is subject to the validity of the original permit. The Court found that since the original permit was set aside by the High Court, the renewal obtained during the pendency of that decision was rendered void. The judgment in Anjiah v. Regional Transport Officer was disapproved, and it was clarified that the renewal must be considered ineffective if the original permit is invalidated.
