The Supreme Court upheld the Rajasthan (Protection of Tenants) Ordinance, 1949, stating that Section 3, which allows the Rajpramukh to extend the ordinance's duration, constitutes conditional legislation and is intra vires. The Court ruled that the delegation of power to extend the ordinance does not violate Articles 14 and 19(1)(f) of the Constitution of India. The judgment also dissented from Jatindra Nath Gupta v. The State of Bihar, asserting that such delegation is valid under constitutional law.
