Judgment text excerpt

The Supreme Court upheld the constitutionality of the Bombay Lotteries and Prize Competitions Control and Tax (Amendment) Act, 1952, which amended the original Act to include prize competitions conducted through newspapers published outside the State. The Court ruled that the Act was valid under Entries 34 and 62 of List II of the Seventh Schedule, relating to betting and gambling, and that it had sufficient territorial nexus as required by the Constitution. The Court affirmed that the Act did not violate the fundamental rights under Article 19(1)(g) or the freedom of inter-State trade under Article 301.
