Judgment text excerpt

The Supreme Court held that the Orissa Motor Vehicles (Regulation of Stage Carriage and Public Carrier’s Services) Act, 1947 and its amendment did not violate the fundamental rights of the petitioners under Articles 14, 19(1)(f), 19(1)(g), 31(2), and 301 of the Constitution. The Court found that the classification of transport service owners into different groups based on operational routes was not discriminatory and did not infringe upon the equal protection of the law. The Court upheld the validity of the Acts, ruling that the provisions did not amount to confiscation without compensation, as the owners of Stage Carriage Services were treated as distinct classes under the law.
