Judgment text excerpt

The Supreme Court upheld the constitutional validity of the Assam State Acquisition of Zamindaries Act of 1951, as amended by Assam Act VI of 1954, affirming the High Court's decision. The Court ruled that the Act was enacted according to law and did not infringe upon the fundamental rights under Articles 31(2) and 14 of the Constitution. It clarified that the repeal of the Government of India Act, 1935, by Article 395 of the Constitution did not invalidate the Bill pending before the Governor General, thus allowing the State Legislature to continue its proceedings under Article 389.
