Judgment text excerpt
The Supreme Court held that Section 52-A of the Insurance Act, 1938, allows the Central Government to appoint an Administrator for insurers engaged in both life and general insurance if their actions are prejudicial to life policy-holders. The Court clarified that while Section 52-A does not apply solely to general insurance businesses, it does extend to those combining both types of insurance. Furthermore, the Court ruled that grounds not raised in the original petitions under Article 32 cannot be introduced during the hearing.
