The Supreme Court held that under Section 120-A of the Indian Penal Code, a criminal conspiracy requires at least two parties, and one person cannot be convicted of conspiracy if the alleged co-conspirators are acquitted. In this case, three out of four accused were acquitted of conspiracy charges under Section 120-B IPC, leading to the conclusion that the fourth accused could not be found guilty of the same offence. The Court thus overturned the High Court's conviction of the appellant for conspiracy, reinforcing the principle that conspiracy cannot exist in isolation.
