The Supreme Court held that under the Madras Estates (Abolition and Conversion into Ryotwari) Act, 1948 (Madras Act XXVI of 1948), a darmila inam that pertains to a fraction of a village retains its character as part of the estate, thus vesting in the State under Section 3(b) of the Act. The Court rejected the contention that the notification was ultra vires, affirming that the one-sixteenth portion of Karuppur village was included in the estate as defined in Section 3(2) of the Madras Estates Land Act, 1908. The Court also ruled that the darmila minor inamdar is entitled to compensation for the transfer of his portion to the Government, but is not protected under Section 20 of the Act.
