SHYABUDDINSAB MOHIDINSAB AKKI vs THE GADAG-BETGERI MUNICIPAL BOROUGHAND OTHERS.

The Supreme Court held that the special general meeting of the Municipality on 3rd August 1954 was valid despite objections regarding the term of the President being less than a year, as it complied with the requirements of the Bombay Municipal Boroughs Act, 1925, specifically Section 35(3). The Court ruled that the adjournment of the meeting on 30th July 1954 and the subsequent proceedings were conducted under the authority of the Collector, thus upholding the election of the President and Vice-President. The High Court's dismissal of the appellant's application under Article 226 challenging the validity of the meeting was affirmed.
