The Supreme Court held that Article 7 of the Constitution of India overrides Article 5, establishing that a person who migrated from India to Pakistan after March 1, 1947, cannot be deemed a citizen of India. The court ruled that Kumar Rani, who migrated in 1948, did not retain her Indian citizenship despite her domicile being linked to her husband in India. Additionally, the definitions of 'evacuee property' in the Administration of Evacuee Property Ordinance, 1949, and the Administration of Evacuee Property Act, 1950, include interests held as a trustee or beneficiary, encompassing wakf property as well.
