Judgment text excerpt

The Supreme Court ruled that the conditions imposed on the cinema theatre licensee under Section 8 of the Cinematograph Act, 1918, were unreasonable restrictions on the right to carry on business as guaranteed under Article 19(1)(g) of the Constitution of India. Specifically, conditions requiring the exhibition of approved films of specified lengths were found to infringe upon the appellant's fundamental rights. Consequently, the Court declared these conditions void and upheld the appellant's right to operate without such restrictions.
