The Supreme Court ruled that the scale of dearness allowance fixed by the Government of Central Provinces and Berar did not violate Article 14 of the Constitution, as it is a matter of discretion under Rule 44 of the Fundamental Rules. The Court held that there is no enforceable right for government servants to claim dearness allowance, and thus no mandamus could be issued to compel the State to grant it. The Court distinguished previous cases, affirming that different rates for different slabs of salaries are permissible under the Constitution.
