The Supreme Court interpreted Section 17 of the Government of Part C States Act (XLIX of 1951) to establish that disqualifications for Parliament members under Article 102 also apply to State Assembly elections. It held that Section 7(d) of the Representation of the People Act (XLIII of 1951) was not applicable to Part C States elections. Furthermore, the Court ruled that appointing a government servant as a polling agent does not violate Section 123(8) of the Representation of the People Act, as such an appointment does not inherently infringe upon the provisions of that section.
