The Supreme Court ruled that after the adoption of the Constitution, India is no longer a British possession, thus Section 12 of the Fugitive Offenders Act, 1881, does not apply. The Court held that extradition of individuals from India to British territories must be governed by arrangements between the Indian government and the British government, necessitating appropriate legislation. Furthermore, it was determined that Section 14 of the Fugitive Offenders Act, 1881, is void as it is discriminatory and violates constitutional provisions.
