Judgment text excerpt

The Supreme Court ruled that the first part of clause 25 of the Rajasthan Foodgrains Control Order, 1949, is constitutionally valid under Article 19(1)(f) as it aims to ensure equitable distribution of foodgrains. However, the latter part of the clause, which allows requisitioning of stocks at arbitrary prices, violates both Article 19(1)(f) and Article 31(2) due to unreasonable restrictions on trade and lack of compensation principles. Consequently, the Court upheld the High Court's decision declaring the latter part void.
