Judgment text excerpt
The Supreme Court held that Section 8-A of the Rajasthan Ordinance XXVII of 1948, as amended, is void under Article 14 of the Constitution of India. The Court found that the provisions of the Ordinance violated the principle of equality before the law, thereby infringing the fundamental rights guaranteed by the Constitution. Consequently, the Court upheld the High Court's decision to restrain the State of Rajasthan from collecting rents from tenants of the Jagir of Bedla, affirming the judgment that declared the Ordinance ultra vires.
