Judgment text excerpt

The Supreme Court ruled that the revocation of Jagirs and Muafis granted to the petitioners violated Article 31(1) and Article 19(f) of the Constitution, thus entitling them to a writ under Article 32(2). The Court held that no State Government has the authority to perform acts of State that infringe upon citizens' rights. Furthermore, it established that accessions by Rulers of States and their acceptance by the Dominion of India are acts of State, which cannot be questioned by Municipal Courts as per Article 363 and the proviso to Article 131.
