Judgment text excerpt

The Supreme Court held that under customary law applicable to agricultural Jats of Village Ralla, the daughter’s sons inherit non-ancestral property to the exclusion of collaterals. The Court ruled that a gift made by a daughter to her sons constitutes an acceleration of succession. Furthermore, the omission of a small portion of property from the gift due to oversight does not invalidate the surrender, provided it is bona fide. The appeal was dismissed, affirming the lower court's decision.
