Judgment text excerpt

The Supreme Court ruled that the liability to pay rent under a lease does not fall under the term 'financial obligations' as defined in Article 9 of the Indian Independence (Rights, Property and Liabilities) Order, 1947. The Court held that the Government of West Bengal is liable to pay rent accrued up to 15th August 1947 under Article 8(2)(a) of the same Order. The judgment clarified the interpretation of the articles concerning the financial responsibilities of the Province of Bengal post-independence.
