Judgment text excerpt

The Supreme Court ruled that the Special Tribunal Regulation, V of 1358 Fasli, was valid for past transactions despite contravening Article 14 of the Constitution, as Article 13 does not have retrospective effect. The Court held that the proceedings of the Special Tribunal, which commenced before the Constitution came into force, were valid and could not be impeached. The dissenting opinion argued against the validity of the Regulation post-26th January 1950, citing violations of Articles 14 and 21.
