Judgment text excerpt

The Supreme Court held that Section 111(g) of the Transfer of Property Act, 1882, as amended in 1929, does not apply to leases executed before April 1, 1930, and does not impose a requirement for written notice to terminate a lease for non-payment of rent. The court maintained that a suit for ejectment can be filed without such notice if the lease explicitly states that the lessee's rights terminate upon default of payment. The appeal was dismissed, affirming the lower courts' decisions granting possession to the lessor.
