The Supreme Court ruled that neither Section 4 of the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947 nor the newly inserted Section 3-A in the Bombay Housing Board Act, 1948 by the Bombay Housing Board (Amendment) Act, 1951 is ultra vires Article 14 of the Constitution of India. The Court established that the provisions in question do not violate the right to equality as enshrined in the Constitution. Consequently, the petition challenging the validity of these provisions was dismissed.
